What Is A DWI / DUI? And Are You Required to Take a Blood Alcohol Test?

DWI / DUI stands for driving while impaired / driving under the influence. In New Jersey, a person who is charged with a DWI is considered impaired when their blood alcohol content (BAC) measures at .08% or above. A person is considered DUI when they are impaired and driving under the influence of drugs. A person’s BAC is most often determined with a machine that measures the alcohol content based on a person’s breath called the Alcotest. Breath tests are usually performed at the police station after a driver is stopped in their motor vehicle; however, the police may, at times, seek to conduct blood or urine tests at the municipal detention facility.
