NJ Supreme Court Certified Defense Lawyer Michael Rubas Represents Clients Involved in Probate & Estate Litigation

The Rubas Law Offices works with fiduciaries, beneficiaries, individuals, and estate creditors in probate litigation cases. Contested wills are one of the most unfortunate possibilities confronting executors and estate administrators. Moreover, because most contested actions are initiated by close relatives within the decedent’s family, probate litigation is often more bitter and emotional than other civil matters. Accordingly, the firm aggressively protects the rights of its clients while at the same time showing compassion for grieving family members.

Probate Attorney Michael Peter Rubas has experience advocating for the rights of clients in all estate and probate matters such as:

  • Will Contests
  • Claims of Undue Influence and Duress
  • Lack of Testamentary Capacity
  • Power of Attorney Disputes
  • Accounting Demands
  • Removal of an Executor
  • Actions Challenging Trustees

Mr. Rubas’ approach while handling these sensitive matters is to litigate when only necessary; however, sometimes litigation is a must. For example, In the Matter of the Estate of Georgia Tsairis, Deceased (Docket No.: ESX-CP-0070-2009) (Ch. Div. 2011), Mr. Rubas’ clients were proven victorious after a twelve-day trial before the Essex County Superior Court, Probate Part. In that action, the firm filed a Verified Complaint seeking to set aside a deed transfer and a declaration that a prior will was the product of undue influence. After hearing the testimony from ten witnesses, the Court agreed with Mr. Rubas’ arguments and held both the deed and will invalid. As a result, Mr. Rubas’ clients who had received nothing, were able to receive three-fourths of the Testamentary Estate under the laws of intestacy.

Because Probate litigation matters are assigned to specialized courts, Mr. Rubas is the right choice for handling these difficult and sensitive matters.
